While the practice is meant to coerce people into paying their fines, some studies suggest that the practice does not increase collections of fines. And supporters of the bill say that the practice punishes the poor and traps people into a cycle of debt.

“When someone’s license is suspended because they are unable to afford to pay off their fines and fees, they are placed in an impossible situation,” Jonathan Cohn, the Policy Director of Progressive Massachusetts, wrote in testimony in support of the bill in July. “If they stop driving, they might lose access to job opportunities that they need to pay the fine. If they continue driving, then they risk further punishment.”

Let’s Lift Our Kids out of Deep Poverty

Chair Kennedy, Chair Livingstone, and Members of the Joint Committee on Children, Families, and Persons with Disabilities:

Progressive Massachusetts is a statewide, multi-issue, grassroots membership organization focused on fighting for policy that would make our Commonwealth more equitable, just, sustainable, and democratic. We urge you to give a favorable report to H. 214 and S. 118: An Act to lift kids out of deep poverty.

These bills would raise cash assistance grants by 20% a year until they reach 50% of the federal poverty level (FPL), and then adjust them annually so that they remain at 50% FPL and do not lose their value over time.

We appreciate the Legislature’s commitment to addressing deep poverty. The Committee favorably reported prior versions of these bills in three previous legislative sessions and included increases to cash assistance grants in the last five budget cycles, from FY21 to FY25.

However, the question of whether to raise cash assistance grants should not need to be revisited every year.  Instead, as the bills provide, grants should be increased more rapidly to reach the modest Deep Poverty level and then increased each year to keep up with increases in the cost of living.

The current maximum TAFDC grant of $861 a month for a family of three with no income is still less than half of the federal poverty level—Deep Poverty—currently $1,110 a month. Grant amounts for EAEDC cash assistance for older adults and people with disabilities are even lower, at only $441 a month for an individual, compared to the Deep Poverty level of $652 a month. With grant amounts this low, families cannot afford basic necessities, forced to decide whether they can afford food or medications or a roof over their head.

Please give your full support to these bills. It is time to end Deep Poverty in Massachusetts.

Testimony in Support of Road to Opportunity Act

Chair Crighton, Chair Arciero, and Honorable Members of the Joint Committee on Transportation:

My name is Jonathan Cohn, and I am the Policy Director of Progressive Massachusetts, a statewide grassroots advocacy group with chapters across the state committed to fighting for an equitable, just, democratic, and sustainable Commonwealth.

We urge you to give a favorable report to H.3662 and S.2368, An Act to increase opportunity by ending debt-based driving restrictions, also referred to as the Road to Opportunity Act. This bill would end debt-based driving restrictions that irrationally punish people who can’t pay outstanding fines and fees.

Being poor in the United States is expensive, and debt-based driving restrictions are but one of many examples. When someone’s license is suspended because they are unable to afford to pay off their fines and fees, they are placed in an impossible situation. If they stop driving, they might lose access to job opportunities that they need to pay the fine. If they continue driving, then they risk further punishment. Driving on a suspended license is a misdemeanor in Massachusetts; it can result in a jail sentence or immigration consequences, an extended period of license suspension, and even more fines. A second offense carries a mandatory minimum jail sentence of 60 days’ incarceration. On top of all of this is the lasting harm done by having a criminal record, which can become a roadblock to housing and job opportunities for years to come.

The status quo exacerbates racial inequalities. Because communities of color are over-policed and disproportionately targeted for enforcement of minor infractions and crimes, research shows that they also disproportionately experience debt-based license suspensions.

Not being able to pay a fine does not make someone a reckless driver. The bill leaves in place license suspensions for unsafe driving, where a public safety interest exists. But no one is made safer by criminalizing poverty.

License suspensions for unpaid debts do not work as a pressure tactic and don’t succeed at bringing in revenue, and it’s no surprise why: if someone doesn’t have to pay the money for the fine, increased punishments won’t make that money magically appear. The only thing that such punishment manifests is more harm and lost opportunity.

Over half of states across the country—red, blue, and purple—have passed legislation to eliminate or significantly curb debt-based license suspensions. We urge you to add Massachusetts to this growing list of states by voting H.3662 and S.2368 out of committee favorably and supporting its prompt passage.

House FY 2025 Budget Action Alert

Last year, Massachusetts passed critical legislation to guarantee free communication in prisons and jails, the most comprehensive such legislation passed in the country so far. With No Cost Calls in effect, the number of calls made from MA’s prisons rose by more than 60% in January relative to just a few months prior, and the number of electronic messages sent nearly tripled, meaning that people who are incarcerated are better able to stay connected with their loved ones back home.

But the larger work of keeping families connected is not done. We need to make sure that there is robust reporting to ensure full and effective implementation by the Department of Correction and county jails, and we need to build on the win of No Cost Calls by improving access to in-person visitation as well.

Please contact your state representative by next Tuesday (4/23) to urge them to co-sponsor the following amendments to the FY 2025 budget:

  • #975 and #986, amendments to No Cost Calls (These amendments make technical fixes and improvements to reporting requirements with the aim of maximizing effective implementation of free communication in prison and jail)
  • #1263, “Strengthening Community Connections”  (This amendment mirrors legislation to improve access to in-person visits)

Tell Gov. Healey to Stop the Cuts

Earlier this month, Governor Healey responded to a revenue shortfall by making $375 million in unilateral 9C cuts to the budget, including cuts to cash assistance to the lowest-income families in the Commonwealth.Please help keep up the pressure on the Governor to rescind the cash assistance cuts that eliminated the 10% grant increases slated to take effect in April. We should not be balancing the budget on the backs of our lowest-income children and families, elders, and people with disabilities.

Show Your Support for Universal School Meals

Over 1 in 5 households with children in Massachusetts are struggling to put food on the table. School meals take the pressure off family budgets and allow families to put food on the table day-to-day.

Ensuring that students receive proper nutrition would reduce health care costs, improve student attendance, improve socio-emotional health, and improve student performance. We have seen the success of the program already, and it’s time to make it permanent.

The House included tuition equity in its FY 2024 budget, but the Senate did not, and it has been a sticking point in ongoing negotiations.

Show Your Support for Tuition Equity

From a recent coalition letter organized by our friends at the Massachusetts Immigrant & Refugee Advocacy Coalition: Immigrant advocates and higher education leaders in Massachusetts have long supported broad access to an affordable public college education for immigrant youth, particularly those without status who arrived in the U.S. as children and have been educated in our public schools. Currently these students are required to pay out-of-state or international tuition rates (up to four times the in-state rate). They are overwhelmingly from low-income, hardworking families, often with substantial responsibilities to contribute to family income, but lack access to both federal and state student financial aid. This combination effectively denies some of our most ambitious and talented high school graduates from continuing their education and contributing to the Massachusetts economy.

The Senate included tuition equity in its FY 2024 budget, but the House did not, and it has been a sticking point in ongoing negotiations.

The Joint Higher Education Committee will be holding a hearing on Tuition Equity legislation next Tuesday at 1 PM.

Show Your Support for a Zero-Carbon Renovation Fund

With extreme heat and extreme flooding already, this summer has shown that we are already living with the realities of climate change.

The Zero-Carbon Renovation Fund (ZCRF) bill would jumpstart the market for zero carbon renovations with a $300 million fund devoted to (1) maximizing energy efficiency through building envelope upgrades, (2) electrification of building systems, (3) maximizing usage of on-site renewable energy, wherever possible, and (4) use of building retrofit materials that are low embodied carbon.

With an understanding that our sustainability transition must be an equitable one to be successful, the ZCRF would prioritize affordable housing, public housing, low- and moderate-income homes, schools, BIPOC- and women-owned businesses, and buildings located in Environmental Justice communities.

Due to the ongoing internal fight within the Telecommunications, Utilities, and Energy Committee, the bill has TWO hearings next week: a Senate hearing on Monday and a House hearing on Wednesday.

What’s in the MA House Budget….And What Could Be.

First of all, happy Earth Day! This Earth Day, I’m thinking about how the investments from the Fair Share Amendment will help us improve our public transit systems, a vital part of our response to climate change (as well as reducing air pollution and expanding economic opportunity). The Fair Share campaign recently launched new social media accounts, so if you haven’t followed them yet, make sure to do so on Facebook, Twitter, and Instagram.

A Budget Is a Moral Document

Last week, the MA House Ways & Means Committee released its budget for the next fiscal year.

The Good: The budget avoids the regressive tax cuts for the rich proposed by Republican Governor Charlie Baker, includes the new investments in public schools required by the Student Opportunity Act, and ends the exploitative practice of charging incarcerated individuals for phone calls to loved ones.

The Bad: At the same time, the budget continues our chronic underfunding of public transit and fails to deliver on the investments in child care necessary for true affordability and accessibility.

How the Budget Could Be Better: The House will be considering various amendments next week to improve the budget and better deliver on the promise of shared prosperity and justice for all.

Voting Access for All

Amendment #47 (New American Voters Fund), filed by Reps. Ultrino & Donato: Would allocate $4 million to municipalities and community organizations to hire bilingual election workers, pay for professional translators and interpreters, and train elections departments.

Justice for All

Amendment #902 (ACES), filed by Rep. Sabadosa: Would ensure that every call to 911 gets the best response by providing funding to communities that want to develop alternatives to police response for calls better handled by mental and community health providers, like social workers and peer specialists.

Amendment #936 (Community Empowerment and Reinvestment Grant), filed by Rep. Mary Keefe: Would provide $15 Million for the Community Empowerment Reinvestment Grant Program, which funds reentry and intervention programs.

Amendment #1346 (Youth Bail Fees), filed by Rep. Fluker Oakley: Would (1) eliminate the statutorily-required $40 administrative bail fees charged to juveniles when they are arrested overnight and (2) shift the decision to release a child to their parent or to impose cash bail decisions from the police officer on call to the Bail Magistrate, a neutral 3rd party.

The House budget remains poised to earmark millions of dollars for the incarceration of men civilly committed for treatment of substance use disorder under the statute known as “Section 35” (M.G.L. c.123 s.35).

  • Amendment #332 (Section 35), filed by Rep. Balser: Would eliminate the Governor’s proposed funding for correctional section 35 facilities.  
  • Amendment #333 (Access to Addiction Services), filed by Rep. Balser: Would ensure sufficient bed space in DPH or DMH facilities for men committed under section 35.

Economic Security for All

Amendment #181 (Lift Kids Out of Deep Poverty FY23), filed by Rep. Decker: Would raise cash assistance grants for very low-income families with children, elders, and persons with disabilities by 20% for FY 23.

Amendment #640 (Excluding Temporary COVID Relief Income from FY23 Means Testing), filed by Rep. Elugardo: Would ensure that economic assistance from the CARES Act does not count against anyone’s eligibility for means-tested public assistance programs.

Amendment #802 (Including underemployed and unstably housed youth in “at-risk”), filed by Rep. Elugardo: Would add a focus of creating economic opportunity for youth experiencing homelessness to the YouthWorks Youth Jobs program.

Amendment #881 (Massachusetts Rental Voucher Program), filed by Rep. Madaro: Would cap tenant rent share to 30% income instead of 40% and expand mobile vouchers to cover tenant-paid utilities, among other measures.

Amendments #1068 (RTA Funding) & #1070 (RTA Funding Distribution), filed by Representative Sarah Peake: Would make $101 million in base funding available to the RTAs (an increase from $94 million).

Amendment #1268 (Housing Protections), filed by Rep. Moran: Would extend Chapter 257 eviction protections to cases where landlords seek to recover arrears for non-payment of rent – effectively closing the non-payment loophole – and require landlords to participate in the rental assistance process in good faith before being permitted to file an eviction case in court.

Amendment #1371 (Rental Assistance for Families in Transition), filed by Rep. Decker: Would expand eligibility for RAFT to households with incomes from 50% of the area median income (AMI) up to 60% AMI.

Safe & Welcoming Schools for All

Amendment #1133 (Targeted Intervention to Enhance the Learning of Students in Early Grades), filed by Rep. Uyterhoeven: Would provide funding for student specific supports and interventions that enhance learning during preschool through the third grade and that support the elimination of disciplinary sanctions for this population of students

Amendment #1138 (Student Wellness School Support), filed by Rep. Uyterhoeven: Would provide funding to reduce school exclusion for students in prekindergarten through the third grade by utilizing best practices, increased parent engagement and community-based services to support teachers and school staff to employ alternatives to suspensions and expulsions to address student misbehavior in the early grades

Amendment #1321 (Holistic School Health and Safety Practices Grant Program), filed by Rep. Khan: Would create a grant program, administered by the state’s Department of Elementary and Secondary Education, to support public schools and school districts in transitioning to safety models that do not rely on stationing police in schools.
